Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
...the hazard of being struck by a moving vehicle. On October 21,
1988 Terex trucks 08081 and 08082 which had a restricted view to the
operator's right side, right front and the rear of teh vehicle, were
operated in areas frequented by pedestrian traffic, without
appropriate means to warn pedestrians of an approaching vehicle or
one preparing to move.
Among other means, one feasible and acceptable method of abatement is:
a) To install on the blind side of teh vehicle a mirror which will
permit the operator to view the area on the side of the vehicle and
to the area in front of the radiator.
b) Institute and implement a written policy which requires the operator
to sound a horn or siren distinct from surrounding noise prior to
moving the truck to alert personnel working in the area and driving
other vehicles.
c) In lieu of a written policy to sound a horn prior to moving, install
on vehicles an automatic signalling device to provide a means to
alert personnel working in the area.
