Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
...the hazards of being struck by falling loads and/or portions
of the hoisting boom and load line due to the failure of the upper
chords of the hoist boom, and subsequent failure of the boom girder
on the holmes number RC 60 truck-mounted railroad wrecking service
crane, serial number d-81153, property number 52-4-005.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to replace the damaged boom section for this
unit with a boom certified by the manufacturer as being the equivalent
of original equipment, as required by section 2.3.3.(c)(2) of American
National Standards Institute standard B30.5-1968 Crawler, Locomotive and
Truck Cranes, specified as the maintenance standard by the equipment
manufacturer.
