Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls of over 10 feet as well as struck-by hazards during the operation of a defective lift which occurred on March 19, 1995 and was a result of the lack of preventive maintenance programs for the equipment: The employer did not have a scheduled inspection and maintenance program as recommended by the lift manufacturers and recognized as necessary by ANSI(American National Standards Institute) A92.2-1969 for powered lifting work platforms such as the JLG articulating boom lift and the Lift-A-Loft lifts used by maintenance personnel in the plant.
