Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a) Main Floor Production - Employee(s) using an 8 foot portable wood ladder to gain access to the top of an 11 foot incinerator during fabrication, on or about December 14, 1989. Among other methods, one feasible and acceptable method of abatement to correct this hazard would be to use a ladder that extends at least three (3) feet above working surface.
