Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
a fall hazard of eight feet onto concrete floor and/or heavy gage metal
springs protruding up from the floor:
a) Riverview Manor - Service elevator shaft with a metal portable ladder
eight feet long used to enter a shaft eight feet deep that did not
extend at least 36 inches above the platform to enable safe entry or
exit. On or about September 12 and 13, 1989.
Among other methods, one feasible and useful abatement method is to
utilize an extension ladder which would extend 36 inches above the
landing platform.
