Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
a potential crush hazard from lifting loads with a hand chain powered
hoist not clearly marked with the rated capacity and legible from the
operating position not inspected for wear, and no record of load
testing:
a) Main Shop - Employees used the hand chain powered hoist to remove
fiberglass or steel tanks from lawn care trucks to work on mixing
shaft, on or about February 12, 1990.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is as follows:
a) Mark the hoist with its rated load so that it is clearly legible
from the operating position.
b) Frequently inspect braking mechanism for evidence of slippage
underload, the load chain for wear, twists, broken, cracked, or
otherwise damaged links and the hook for deformation, chemical
damage, or cracks.
c) Periodically inspect for excessive wear of the chain, load sprockets,
idler sprockets or chain stretch, have the hooks checked using
suitable crack detecting inspection, check the entire assembly for
any worn, cracked or distorted parts, supporting structure for any
potential failure.
d) Keep written, dated and signed inspection records.
