Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm of being infected with Hepatitis B Virus (HBV)
and/or Human Immuno Deficiency Virus (HIV) through possible direct
contact with blood or other body fluids:
a) Yater Medical Group - Employees performing laundering and
janitorial duties were not provided with universal precaution
training on HIV/HBV exposing them to possibly contaminated blood
and/or body fluids without the knowledge to protect themselves.
b) Yater medical Group - Employees take home to be laundered
their lab coats and gowns that are possibly contaminated with HIV/HBV
blood and/or bodily fluids.
c) Yater Medical Group - No medical program has been implemented to
offer employees who work with potentially infectious blood and/or
body fluids HBV vaccinations.
Feasible and useful abatement U.S. Department of Health and Human
Services/Center for Disease control policies and procedures for
protection against occupational exposure to HIV and HBV.
1) Effectively implement U.S. Department of Health and Human Service/
Center for Disease control policies and procedures for protective
against occupational exposure to HIV and HBV.
2) Implement effective infection control procedures for laundering
protective clothing.
3) Develop and implement a medical program which offers all employees
exposed to blood and/or body fluids HIV-anitbody testing follow-up.
