Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Landfill-Waste disposal trucks No 301 and No 310 had defective
tail lights exposing employees to the hazard of being struck by
other vehicles.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to replace defective tail lights.
b) Landfill-Waste disposal trucks No. 301, 309, 314, 318, 328, 332,
and 404 had defective backup alarms exposing employees to the
hazard of being struck by a waste disposal truck as it backs up.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to replace defective alarms, and protect them
from future damage.
c) Landfill-Riding steps at back of garbage truck No. 310 were
broken, exposing employees to the hazard of falling off of the
back of the truck.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to ensure that steps are securely attached to the
frame of the truck.
