Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Employees were required to enter a confined space (water storage tank) located at the Industrial Park, Kosciusko, MS and were exposed to potential hazards which included oxygen deficient atmosphere, flammable vapors and toxic atmosphere and the employer had not developed and implemented safety requirements for working in tanks and other confined spaces. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1) Developing and implementing a confined space entry program as outlined in the American National Standards Institute, Inc., ANSI Z117.1-1977, which include but is not limited to the following: i. Provisions for testing for oxygen, flammable gases and vapors, and toxic air contaminants, lockout and/or tagout, ventilation to prevent the accumulation of hazardous atmospheres; ii. Periodically testing for atmospheric contaminants from the lowest to highest elevations of the confined space to determine the conditions that employees may encounter; iii. Developing and implementing entry procedures so that before employees enter a confined space in which potential hazards may exist, a qualified person will determine what steps are necessary to ensure employee safety; or 2) Comply with OSHA's Permit-Required Confined Spaces (Permit Spaces) Standard.
