Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an unintended activation of a foot pedal not protected by a guard: (a) Stair Shop - Employees operate a Ekstrom Carlson radial arm saw, model number 606, no serial number, to cut wood stair treads. No means was provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it, on or about September 29, 1992. Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace the missing foot pedal guard. OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by: (a) Stair Shop - Employees operate a Ekstrom Carlson radial arm saw, model number 606, no serial number, to cut wood stair treads. No means was provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it, on or about September 29, 1992.
