Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to an injury from an unintended activation of an unguarded foot
pedal:
(a)  Shop - Employees operate a Dreis and Krumpt press break,
serial number 6157, to bend  and  form  metal  pieces of
various sizes.  No means  was  provided  to  protect the
foot  pedal  from  unintended  activation  by falling or
moving objects or by someone accidently  stepping on it,
on or about December 30, 1992.
(b)  Shop - Employees operate a combination  hydraulic little
scotchman, no  serial  number, shear  and press to shear
and flatten the ends of  one  (1)  inch pipes.  No means
was provided to protect the foot  pedal  from unintended
activation by falling or moving objects  or  by  someone
accidently stepping on it, on or about December 30, 1992.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to provide a guard over the food pedal.
OR IN THE ALTERNATIVE
29 CFR 1910.212(a)(1):   Machine guarding was not provided to protect
operators and other employees from hazards created by:
(a)  Shop - Employees operate a Dreis and Krumpt press break,
serial number 6157, to bend  and  form  metal  pieces of
various sizes.  No means  was  provided  to  protect the
foot  pedal  from  unintended  activation  by falling or
moving objects or by someone accidently  stepping on it,
on or about December 30, 1992.
(b)  Shop - Employees operate a combination  hydraulic little
scotchman, no  serial  number, shear  and press to shear
and flatten the ends of  one  (1)  inch pipes.  No means
was provided to protect the foot  pedal  from unintended
activation by falling or moving objects  or  by  someone
