Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from improper ladder usage: (a) Shipping/Receiving Area - An eight (8) foot metal step ladder was used to gain access to an eight (8) foot high platform. The ladder did not extend three (3) feet above the platform and employee was using the top step for access, on or about February 11, 1992. (b) Storage Area Above Office - A fiberglass extension ladder was used to gain access to the 2nd floor level and did not extend three (3) feet above landing, on or about February 11, 1992. Among other methods, one feasible and acceptable method to correct this hazard is to ensure that the ladder extends at least three (3) feet above the landing and that step ladders not be used where employee must step on ladder cap.
