Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: A) New Penn Trucking Terminal, Exterior, North Side - An employee was working approximately 10 to 12 feet above the ground level on an elevated platform powered by a pesa powered industrial lift. The platform was not secured to the lifting carriage, there was no access opening on the platform and there was no operator in the control position of the powered lift, on or about November 15, 1990.
