Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard of twenty (20) feet: (a) Weis Market, Bern Road, Wyomissing, Pennsylvania - Employee observed standing on the edge of a 20 foot roof using a sledge hammer to knock the brcik veneer off the building, on or about September 23, 1991. Among others, one feasible and useful means of abatement method to correct this hazard is have the employee wear a safety belt and lanyard or to construct a catch platform: OR, IN THE ALTERNATIVE 29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employees in all operations where there was exposure to hazardous conditions: (a) Weis Market, Bern Road, Wyomissing, Pennsylvania - Employee observed standing on the edge of a 20 foot roof using a sledge hammer to knock the brcik veneer off the building, on or about September 23, 1991.
