Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm:
a) The embalmer and embalmer assistant were exposed to the hazard of
being infected by HBV and HIV through possible direct contact with
blood or other body fluids, on or about August 14, 1990.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
1) Making available, at no cost, hepatitis B vaccinations for embalmer
and embalmer assistant.
2) Developing follow-up procedures for implementation after possible
exposures that include HBV/HIV testing of the source and employee
(after obtaining proper consent) and other appropriate procedures
as outlined by CDC.
