Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of operating a sole laying machine without adequate training
or supervision to prevent a point of operation injury.
Among other methods, one feasible and acceptable method to correct this
hazard is by training the employees in the proper set-up techniques for
the sole laying machine and then providing adequate supervision to
monitor his work habits until he has demonstrated competency in all
aspects of machine operations:
Sole Laying Area - On or about 09/29/89, a new employees, on
the job for two days, had his left thumb fractured and crushed
losing about 1/4 inch of bone at the tip. The employee had not
been adequately trained or supervised to recognize the hazard
created when improper jacks were used for the pressing operation.
