Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were exposed to a potential fall hazard while operating the manually operated manlift due to the lack of a car enclosure. Among other methods, one feasible and acceptable method to correct this hazard would be to install a complete car enclosure with a gate on the manlift car. (b) Employees were exposed to a potential crushing hazard while working near the manually operated manlift due to the lack of a guardrail system around the base of the manlift. Among other methods, one feasible and acceptable method to correct this hazard would be to install a standard guardrail system with an entrance gate around the base of the manlift.
