Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an overhead hazard: (a) For employees working in the "A" room and exposed to a potential head injury created by the overhead cottage cheese conveyor. Among other methods, feasible and acceptable abatement methods to correct this hazard would be to: 1. Raise the conveyor to the height of 6 feet, 8 inches as specified by ASME B20.1- 2000 section 5 paragraph 5.10 (a); or 2. Suitably guard and readily mark the conveyor to identify low headroom as specified by ASME B20.1-2000 section 5 paragraph 5.10 (c). Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion
