Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) For employees working at the railcar load out on the north side of the
east feed house
and exposed to a potential fall hazard of approximately 15 feet created by
the lack of fall
protection when standing on top of railcars.
(b) For employees working at the railcar load out on the north side of the
#2 feed house
and exposed to a potential fall hazard of approximately 15 feet created by
the lack of fall
protection when standing on top of railcars.
(c) For employees working at the railcar load out on the north side of the
west main
elevator and exposed to a potential fall hazard of approximately 15 feet
created
by the
lack of fall protection when standing on top of railcars.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to install a fall protection system at the railcar load out on
the north side of the
east feed house, #2 feed house, and west main elevator.
