Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to: a). Being struck and/or crushed by the hoisted and suspended load on the "Budgit" half-ton air hoist, SN 920497, while working in Building 16 at the Rotary Drier Charging Operation (9/8/94). The hoist had a damaged and loosened hook latch, which left the hook and chain susceptible to "roll-out". The "supersac" load was not attached to the hook of the hoist by means of slings or other approved devices. The brakes on the hoist were subject to abnormal wear and stress because of the jogging method of discharging the wetcake load from the "supersac". Testing of the brakes was not done as specified by the manufacturer in the operation manual. These hazards are in conflict with the recognized standard, ANSI B30.16 - 1973. Among other methods, a feasible and acceptable abatement method to correct these hazards is to repair the safety latch on the hook, use an approved device or sling to attach the "supersac" to the hook, and to test the brakes on the hoist with the rated load according to the manufacturer's recommendation.
