Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: THE ROTATING SUPERSTRUCTURE OF THE FIELD MOBILE CAT 235 EXCAVATOR USED ON JOBSITE FOR SITE WORK ACTIVITIES. AMONG OTHER WAYS ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO TRAIN AND INSTRUCT WORKERS DAILY IN THE HAZARDS ASSOCIATED WITH THE EXCAVATOR'S OPERATION AND TO AFFIX THREE DECALS ON THE ROTATING COUNTERWEIGHT INFORMING WORKERS OF THE HAZARD PRESENT.
