Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: THE UNGUARDED ROTATING SUPERSTRUCTURE OF THE FIELD MOBILE JOHN DEERE ELC EXCAVATOR USED ON THE JOBSITE FOR SITE WORK ACTIVITIES. AMONG OTHER WAYS TO ABATE THIS HAZARD ONE ACCEPTABLE AND FEASIBLE METHOD WOULD BE TO INSTRUCT AND TRAIN WORKERS DAILY IN THE HAZARDS ASSOCIATED WITH THE EXCAVATOR'S OPERATION AND TO AFFIX THREE DECALS ON THE ROTATING COUNTERWEIGHT INFORMING WORKERS OF THE HAZARDS PRESENT.
