SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACTO OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO UNEXPECTED FALLS OF EMPLOYEES AND EQUIPMENT BEARING MATERIAL TO A DIFFERENT LEVEL: A) EAST END OF BLDG., LOADING BAY 1-2 ON 9/25/90- MALFUNCTIONING LOADING DOCK LEVELERS AT LOADING BAYS' 1 AND 2 EXPOSED EMPLOYEES USING MATERIAL HANDLING EQUIPMENT TO A FALL OF 4 1/2 FT. TO THE CONCRETE LOADING BAY FLOOR. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO: 1) CONDUCT A PREVENTATIVE MAINTENANCE AND INSPECTION PROGRAM AS RECOMMENDED TO THE MANUFACTURER IN ACCORDANCE WITH ASME/ANSI MH 14.1 - 1987 EDITION. 2) CONDUCT SAFETY TRAINING OF ALL EMPLOYEES WHO USE THE DOCK LEVELERS AND INSTRUCT THEM ON THE HAZARDS ASSOCIATED WITH THESE DEVICES.
