Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: being pinned under, crushed or thrown from industrial powered trucks, during accidents as defined in the most current version of the consensus standard ANSI B56.1 (ASME/ANSI B56.1a -1989 addenda to ASME/ANSI B56.1 -1988 and ASME B56.1 -1993 SAFETY STANDARDS FOR LOW LIFT AND HIGH LIFT INDUSTRIAL TRUCKS). SOUTH ROOM OF PLANT: THE EMPLOYER FAILED TO INSURE THE USE OF SEAT BELTS BY AN EMPLOYEE WHO WAS OPERATING CLARK FORK LIFT MODEL #GPX17E, TYPE LP, SERIAL #GPX127E-0380-9350KOF, WHICH IS EQUIPPED WITH FACTORY INSTALLED OVERHEAD GUARD AND SEAT BELTS. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD WOULD BE TO TRAIN EMPLOYEES TO ALWAYS USE THE SEAT BELTS PROVIDED. SPECIFIC ABATEMENT DOCUMENTATION AND CERTIFICATION IS REQUIRED
