Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being struck by heavy welded wire panels while lifted by shop built spreader beam that was not load tested and did not have load rating markings visible at the worksite located at 24 Herring Road, Newman, Georgia, on or about April 7, 1989. One feasible and acceptable abatement method to correct this hazards is to load test the units to 125% of the maximum intended use rating and stamp beam identification, weight, and load rating.
