Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: A) Paint Spray Booth - Employees using job made ladder that had side rails measuring 3/4" x 3" and cleats that were not inset into edge of side rails and had no filler blocks between cleats were exposed to a fall hazard. Observed 09/27/90. Abatement Note: A feasible abatement method would be to construct a ladder that meets the requirements of ANSI A 14.4 - 1973, Section 4, construction requirements, using 2 x 4 lumber for side rails and having cleats inset.
