Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a hazard of being crushed in the event of a
failure of the
automotive lift to remain raised. A feasible and useful method to correct
this hazard, among
others, is to follow all the manufacturer's requirements as well as the
consensus standards as
to the construction, care, maintenance, and use of the automotive lift.
a)   ESTABLISHMENT:  LINE-O-TRONICS FLOOR MOUNTED TYPE AUTOMOTIVE
LIFT, MODEL NUMBER 315, WEIGHT CAPACITY 8000 LBS.:  THE AUTOMOTIVE
WAS NOT MAINTAINED IN THAT THE OPERATORS MANUAL WAS NOT
MAINTAINED AT THE WORKPLACE IN A CONSPICUOUS PLACE, THE
HYDRAULIC PISTON WAS LEAKING, PERIODIC INSPECTIONS WERE NOT MADE
IN ACCORDANCE WITH THE LIFT MANUFACTURERS RECOMMENDATIONS, THE
LIFT CONTROL MECHANISM WAS DEFECTIVE IN THAT IT DID NOT RAISE THE
LIFT, THE MECHANICAL LOCKING DEVICE USED TO HOLD THE LIFT IN THE
EXTENDED POSITION HAD DEFECTIVE LINKAGE AND BEARING SURFACES
AND THE LIFT WAS NOT IDENTIFIED WITH A LABEL TO ASSURE THAT IT WAS
IN COMPLIANCE WITH THE AMERICAN NATIONAL STANDARD/AUTOMOTIVE
LIFT INSTITUTE REQUIREMENTS B153.1.
