Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an amputation hazard due to inadvertent activation: a) Verson press brake, serial number 27448-3010-90, in the fabrication area of the shop did not have a guard for the foot activation pedal, on or about March 7, 1990. A feasible method of control is the installation of a foot pedal guard to prevent accidental activation.
