Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to increased fire and explosion hazards: The alleged violations below have been grouped because they involve similar or related hazards that may increase the potential for injury resulting from an accident. a) Center of Mezzanine, Around Bottom of Tank - Flammable paint spillage had been absorbed by layers of cardboard, which continuously added to the fuel load and vapor liberation hazards, on or about December 31, 1991. b) Second Floor, Around M24 Mixer - Spills of flammable liquids, paints, and resin dusts had been absorbed or covered with cardboard, which continuously added to the fuel load and vapor liberation hazards, on or about January 28, 1992. c) Above Production Fill-Off Area, on Walkway Around Finishing Tanks - This metal platform was covered with cardboard, adding combustible material to the building's fuel load hazards, on or about January 28, 1992. Among other methods, one feasible and acceptable abatement method to correct this hazard is to remove cardboard from all floor areas, clean up these areas, train employees in proper clean-up methods and absorbents, and to implement a regular housekeeping program including a prohibitan on the use of combustible materials in this manner.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: The alleged violations below have been grouped because they involve similar or related hazards that may increase the potential for injury resulting from an accident. a) Second Floor, Storage Area - Hundreds of 55 gallon drums of pigment, solvent, resins, additives, finished product, etc., hundreds of five gallon cans of house paint, absolete stock, etc., and uncounted one gallon cans of old stock are stored here, with a ten foot wide open doorway connecting it to the manufacturing area, on or about December 11, 1991. b) Mezzanine - Approximately 150 55 gallon drums of flammable stock and dirty wash solvent are stored here, immediately underneath second floor production (with a wooden floor, not vapor tight) and completely open to and immediately above the first floor production area, on or about December 11, 1991. c) First Floor, Warehouse Area - Unknown amounts of flammable raw materials and finished product are stored here, with two openings (approximately 10 inches wide) connecting it to the manufacturing area, on or about December 30, 1991. Among other methods, one feasible and acceptable abatement method to correct this hazard is to cut off the storage area from the manufacturing operations by a wall or partition having a fire resistance rating of at least two hours, and equip openings with approved fire doors, or to remove storage from the manufacturing building.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a) First Floor, Mixing Area - A 15 horsepower "Hockmeyer" mixer of oil-base paint, mixer M20 with 80 gallons of flammable (xylene) paint, and a 15 horsepower "Hockmeyer" mixer with 200 gallons of flammable (xylene) paint were uncovered, allowing vapors to freely form explosive mixtures with air, on or about December 11, 1991. b) Second Floor, 30 Horsepowere "Hockmeyer" Mixer - A 20 gallon batch of flammable paint in a 100 gallon mixing tank was covered with cardboard, on or about January 29, 1992. c) Second Floor, M24 Mixer - A 55 gallon drum of solvent (xylol), approximately 1/3 full, was being used to clean the mixer blades, without a cover, on or about January 28, 1992. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use mixers of the enclosed type or to provide open mixers with properly fitted covers made of a nonferrous spark-resistant material.
