Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to closing machine components due to accidental actuation of unguarded foot control: The alleged violations below have been grouped because they involve similar or related hazards that may increase the potential for injury resulting from an accident. a. Production Area; 2nd Floor - No guard was provided over the foot control which was used to actuate the Vertrod Thermal Impulse Heat Sealing Machine (Model 20 PCB/SL), observed on or about January 7, 1992. Among other methods, one feasible and acceptable abatement method to correct this hazard is place a guard over the foot pedal so that falling material or an unitended step cannot make contact with the pedal and set the machine into its operating cycle.
