General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to unguarded foot treadle and/or pedal: a) Employees cut metal sheets on a Niagara Shear. The machine foot treadle control is not protected to prevent accidental actuation by falling or moving objects, or by someone accidentally depressing it, thus exposing employees to injury, on or about April 14, 1992. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1. To construct a barrier guard over the top of the pedal. 2. Install a foot treadle locking device. 3. Remove the foot treadle and use alternative, actuation device. b) Employees use a mechanical Buffalo Ironworker to shear and punch metal. The machine foot pedal was not guarded, thus exposing employees to amputation or crushing injuries from inadvertent activation of the pedal, on or about April 14, 1992. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1. Install a barrier guard over foot pedal. 2. Install foot control locking device. 3. Install point of operation guarding on punch.
