Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple fractures due to fall hazard: a) Country Commons Apts Construction Site - Employees used the forks of a Lull Model 844B rough terrain forklift as a work platform to gain access to the exterior portion of the stair tower at the second floor level, approximately 20 feet above the ground. Employee was observed standing directly on forks of the forklift without the use of a properly designed personnel platform or any means of fall protection. The operators manual for the the Lull 844B strictly forbids the use of the machines forks as a work platform, 6/3/91. ABATEMENT NOTE: AMONG OTHERS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO ACCESS THIS ELEVATION BY USING A PROPERLY CONSTRUCTED SCAFFOLD TOWER OR THROUGH THE USE OF A MACHINE SPECIFICALLY DESIGNED FOR ELEVATING PERSONNEL.
