Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the chain of the conveying system: a) Throughout the Dock Areas, APV Crepaco Basket-Flo Materials Handling System - Employee(s) working on the inside of the system's turns are exposed to being struck by the chain if/when it comes out of the track. Among other methods, one feasible and acceptable abatement method to correct this hazard is to erect a guard or barrier on the inside of the turns to prevent the chain from striking personnel.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by stacks of product: a) Throughout the Dock Areas - APV Crepaco Basket-Flo Materials Handling System - Employee(s) are exposed to being struck by stacks of trays of bread products if/when the system restarts after shutdown. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide an audible and/or visual warning device, activated by the controller device starting the conveyor and continuing for a required period of time before the conveyor restarts.
