Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to equipment that was not maintained in accordance with manufactures requirements. a) Fischbach & Moore - The Aerolift bucket truck (model 3T-36 serial #1533) did not have maintenance as required by the manufacturer for over a year. Also daily inspections were not being done by operators. ANSI A92.2- 1990 also requires user's to follow manufacturer's requirements for maintenance and inspections of equipment. Observed 10/17/97. ABATEMENT NOTE: Among others, one feasible means of abatement to correct this hazard is to have scheduled maintenance performed and have operators perform daily inspections as recommended by the manufacturer.
