Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of falls:
a) Employees working at the south edge of the roof of Bargain Time Store
#782 on March 30, 1989, were exposed to the hazard of falls,
including one employee who sat at the edge with his legs hanging
down, 17 1/2 feet above the pavement.
One feasible and acceptable abatement method among others, to correct
this hazard would be to insure that no employees be permitted on the
roof.
