Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a defective 5/8" wire rope on the rail car winch or puller which had broken strands and was severly mashed and was located at the Overhaul position in the Paint Shop. a) Among other methods, one feasible and acceptable method to correct the hazard is to replace the damaged wire rope with new rope, and to have the operator examine the rope each time it is used to ascertain its conditions, and removal of exposed employees from the area during pulling operation, on or about August 8, 1989.
