Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Upon transferring from positions involving relatively low risk of exposure to blood and body fluid (eg., Nutrition Services workers) to positions involving substantial risk of exposure to blood and body fluid (eg., Housekeeping Aides or Security Assistants), workers were not offered the Hepatitis B vaccine prior to beginning their new work assignments. Feasible and useful abatement methods for reducing this hazard, among others, are: 1. Develop and provide an improved system of verifying that workers, who transfer into positions that involve substantial risk of exposure to blood and body fluid, are offered the Hepatitis B Vaccine prior to beginning their work assignments.
