Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employees working in all aspects of the
"Silver Tank Operation" a place of employment which was free from
recognized hazards that were causing or were likely to cause
death or serious physical harm to employees in that:

(a) A confined space entry program was not written and/or
implemented to protect employees who are exposed to
atmospheres which are potentially deficient in oxygen and which
are in excess of acceptable personal exposure limits of
toxic contaminants.  ANSI Z1176.1 - 1989 American National Standard
Safety Requirements for working in tanks and other confined
spaces contain guidelines for such entry;  which contains
accepted requirements that include:  training personnel;
testing thhe atmosphere; ventilation of the confined space;
stand-by people in constant communication with those inside
a confined space; respiratory protection; permit system
authorizing approval for all work and appropriate
protective measures that are to be provided.
