Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) In that; employees were exposed to hazards created by the use of elevated work platforms which were not designed constructed, and/or used in accordance with the acceptable requirements of the American National Safety Standard for Rough Terrain Forklift Trucks, ANSI B56.6-1987. For example: The personnel platform did not meet the design requirements of that standard in the following areas: 1. Platform dimensions exceeded in width more than 10 (ten) inches greater than the overall width of the truck on either side, and 2. Work platform was not prominently marked with both the empty weight and maximum work load including personnel and equipment, and 3. Work platform was not provided with guardrails, including midrails and toe plates or other means for securing personnel, such as body belts and lanyards; The following precautions were not taken for the protection of personnel using the elevated work platform; 1. The platform was not securely attached to the lifting carriage of forks. The above conditions were observed to exist on September 2, 1992 and involved a JCB Loadall Turbo 530 BHL Telescopic Lift with fork extensions attacted. The work platform was used at the 12 to 14 foot elevations from ground elevation to perform eve, soffit and wall carpentry functions. Among other methods, one feasible and acceptable means to correct these hazards is to assure that the design, manufacture and use of all attachments for Rough Terrain Forklift Trucks is in accordance with the most current American National Standard, B56.6 (presently B56.6-1987), and/or has the prior written approval of the lift truck manufacturer.
