Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment, and a place of employment, which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to: (a) An employee, working on a Liftco Scissors Lift Model #XLS2034H, Serial #27011-211ITPIP, located in the pool area, was exposed to a fall hazard of 25 feet, in that the area in which the employee was maneuvering the scissors lift had an uncovered floor opening and/or depression measuring 18" x 18" x 4". The left rear wheel of the scissors lift became caught in the depression, causing the scissors lift to become off balance and tip over into the swimming pool. ABATEMENT NOTE: One feasible and useful means of abatement would require all exposed depressions be covered.
