The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
such as, but not necessarily limited to, nurses, nursing assistants
and respiratory therapists were exposed to the hazard of being
infected by tuberculosis through repeated prolonged indoor contact
with patients who may be infected with tuberculosis in that Vencor
Hospital:
(a) failed to prevent the spread of infectious droplet nuclei
via source control methods.
(b)  failed to provide the above referenced employees with the
Mantoux Purified Protein Derivative at intervals as recommended
by the Center for Disease Control Guidelines for Preventing
the Transmission of Tuberculosis for Health Care Settings, With
Special Focus on HIV-Related Issues, December 7, 1990/Vol.
39/No. RR-17.
Feasible and useful abatement methods for reducing this hazard
as recommeded by the Center for Disease Control, among others
are:
1.  Establish and maintain proper air flows and differentials
between AFB isolation areas and other areas of the facility as
recommended by the American Society of Heating Refrigeration and
Air Conditioning Engineers and Health Resources and Services
Administration.
2.  Provide affected health-care employees with the Mantoux
Purified Protein Derivative at least every six months.
