Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being stuck with or cut by used hypodermic syringes and sharp edged pieces of metal & glass found in general trash and which may be contaminated with the biological agents known to cause Hepatitis and Acquired Immunedeficiency Syndrome: a) Employees cutting and sorting out garbage on the recycling line were being stuck with hypodermic syringes and cut with pieces of sharp-edge d metal and gloves in the trash and no precautions were taken by the employer to prevent transmission of the Hepatitis B virus (HBV) or the Human Immunodeficiency Virus (HIV). Among other precautions, feasible and accept - able abatement actions to control this hazard include, a) Hepatitis B vaccinations offered at no cost to all employees working on the recycling line, b) Training of employees on the recycling line on precautionary measures available, the epidemiology, modes of transmission and prevention of HIV/HBV infections, the risk to fetuses from HIV/HBV infections, and other associated infectious agents, the locations and proper use of personal protective equipment, proper work practices, the concept of "universal precautions, and procedures to follow if employees suffer a needle stick or contact with other body fluids.

Among other precautions, feasible and acceptable abatement actions to control this hazard include: (a) Tetanus prophylaxis vaccinations offered at no cost to all employ e working on the recycling line. (b) Training of employees on the recycling line on precautionary measures available, the epidemiology, modes of transmission and preven- tion of tetanus infections, the location and proper use of personal protective equipment, proper work practices, and procedures to follow if employees suffer a needle stick or contact with other body fluids.
