Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) At this facility, possibility of severe injury and/or amputation
exists when performing regular maintenance and repairs on the
hydraulic presses, milles and calender machines, such as those
common in the rubber industry. Employees are permitted to perform
these necessary maintenance and repair duties without any uniform
policy which would first employ a positive means of locking out the
main power disconnect of these machines, such as the intent of
protecting workers using the principles of machine lockout/tagoute
discussed in ANSI Z244.1-1982.
Abatement of the hazard can be accomplished by the establishment of
management controls over the work being performed, instruction of
workers in the recognition of hazards, and establishing a positive
lockout program. Specific elements of the abatement program shall be
expected to include but not necessarily limited to:
-Before any maintenance, inspection, cleaning, adjusting or servicing
of equipment (electrical, mechanical, or other) that requires
entrance into or close contact with the machinery or equipment, the
main power disconnect switch or valve, or both, controlling its
source of power or flow of material, shall be locked out or blocked
off with padlock, blank flange, or similar device. Residual energy in
equiment having systems such as pneumatic, hydrualic, compress
springs, or other shall have these systems bled off, blocked or other
effective means implemented to ensure that all sources of energy
have been deactivated.
-Locks keyed separately to ensure removal only by the authorized
person shall be provided to each person working in areas requiring a
lockout. Where more than one person is involved in a single
operation or where multiple operations (such as both electrical and
mechanical maintenance) are being simultaneouslyperformed on a
single piece of equipment, locks shall be used by each person.
-A written lockout policy shall be established, including procedures
for locking out equipment or machinery. Employees involved in
implementing the program shall be trained in all elements thereof.
-It shall be the responsibility of the employer to implement
enforcement guidelines to verify, through periodic inspections, the
employees' compliance with these policies.
