Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck and run over by large trucks backing up to a loading station at an asphalt batch plant causing a crushing injury or death. Employees were routinely on foot in close proximity to backing trucks which did not have a clear view to the rear. Among other methods, one feasible and acceptable method to correct this hazard would be to install back up alarms on the vehicles which had an obstructed view to the rear that would sound when the vehicle moved backwards.
