Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards of broken bones, crushing and possible death while aligning headlights in a very confined area in front of the merrill alignment machine and just behind the emission testing station if the vehicle at the station should accidentally fall into reverse gear. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a restraining device in the floor to stop the vehicle should it accidentally slip into gear OR move the headlight aligning to a safe location.
