Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees were exposed to the hazard of falling and being struck by a Fiat Allis Front End Loader. The loader was used as a mode of transportation by a worker standing on the equipment outside the cab while the loader was in motion. Condition existed Thursday, July 12, 1990. Abatement of the hazard can be accomplished by the immediate removal of personnel riding on equipment except for training purposes, and then only when a seat is provided.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees required to enter a hole in the earth which has been "free bored" were not protected from the hazard of cave-ins created by the shifting of the surrounding earth. This condition existed on Monday, July 9, 1990 when a worker entered and worked inside a 22" diameter hole, approximately 15 feet deep to remove an obstruction which interfered with the drilling operation. Abatement of this hazard can be achieved by the installation of a removable or permanent-type casing of sufficient strength provided for the full length of the free bored hole which is an abatement method recognized by the Horizontal Earth Boring Equipment Manufacturers Council, Wooster, Ohio and the Underground Contractors Association, Chicago, Illinois.
