Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
%%
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The following conditions which increase the risk of employees
contracting bloodborne diseases:
Dental care workers such as Dental Assistants and Dentists were exposed
to the hazard of being infected by bloodborne pathogens such as the
Human Immunodeficiency Virus (Hiv) and the Hepatitis B Virus (HBV)
through possible direct contact with blood or other body fluids.
Feasible and useful abatement methods for reducing this hazard, among
others are the provision of training concerning the matters listed
below:
1) The modes of transmission of the HIV (Human Immunodeficiency Virus)
and the HBV (Hepatitis B Virus).
2) The universal precautions concept.
3) The proper procedures which must be followed to safely containerize
and label refuse and launderable fabric items which have become
contaminated with patient blood or other potentially infectious body
fluids.
4) The epidemology of HBV and HIV.
5) Possible risks to a fetus.
6) The proper procedures which must be followed in regard to the wearing
and care of personal protective clothing and equipment.
7) The contents of CDC's "Update; Universal Precautions for Prevention
of Transmission of HIV, HBV and Other Bloodborne Pathogens in
Health Care Settings."
b) The following conditions which increase the rist of employees
contracting bloodborne diseases:
Dental care workers such as Dental Assistants and Dentists were exposed
to the hazard of being infected by bloodborne pathogens such as the
Human Immunodeficiency Virus (HIV) and the Hepatitis B Virus (HBV)
through possible direct contact with blood or other body fluids.
Feasible and useful abatement methods for reducing this hazard, among
others, are the development and implementation of an Infection Control
Program which specifies what procedures must be followed after an
employee experiences a percutaneous mucous membrane, or non-intact skin
exposure to patient blood or body fluids. The source patient must be
informed of the employee exposure incident and tested for HIV and HBV
infections unless the patient refuses to consent to such testing. If the
source patient tests positive or refuses to be tested, the employee must
be evaluated clinically and by HIV antibody testing as soon as possible,
and advised to report and seek medical evaluation of any acute febrile
illness that occurs within twelve weeks after exposure. HIV sero
negative workers must be retested six weeks post-exposure and on a
periodic basis thereafter (normally twelve weeks and six months after
exposure).
For dental care workers exposed or potentially exposed to HBV, the
recommendations of "The CDC Immunization Practices Advisory Committee:
regarding HBV post exposure prophylaxis (published in the June 7, 1985
Morbidity and Mortality Weekly Report) must be followed.
If an employee refused to submit to a medical test or procedure
described above, no adverse action can be taken against the employee
since these medical procedures were designed for the benefit of the
exposed employee.
2) Ensure that determination of probable corrosion rate and
specification of maximum period between inspections is performed in
accordance with the 1989 ASME Boiler & Pressure Vessel Code and 1989
ANSI/National Board Inspection Code, Sections U-105 and U-106.
3) Train NDE inspectors in ASNT, SNT-TC-1A and require ASNT level II or
equal qualifications for all inspections.
4) Establish an owner-user A.I. or contract an insurance A.I. in
accordance with the ANSI/National Board Inspection and/or API 510
to perform:
a) Inspections of routine repairs to an ASME vessel or piping system in
accordance with 1989 ASME BPV Code, Section VIII, UG-90 through
UG-136, and 1982 API 660, Section 8;
b) Inspections of the fabrication of new vessels in accordance with 1989
ANSI/National Board Inspection Code (NBIC), Chapter II, I-100 through
I-203.8, I-300, AND I-400;
c) Inspections of weld repairs to power pipings in accordance to ASME
B31.1, Power Piping, 1989, Section 102.4.6. (B.2.4 and B.2.2); and
Article 2 Section V of the ASME BPV Code.
5) Perform hardness testing in accordance with 1983 API-RP-941, 1982
API-RP-942, and National Association of Corrosion Engineers Standard
RP-04-72, for vessels and piping in service and subject to hydrogen
attack.
6) Establish an inspection program and perform inspectors of pressure
vessels and piping handling corrosive liquids in  accordance with
1989 ASME-BPV-Code, 1983 API 510, and/or 1989 ANSI/NBIC-23 Sections
I-308.8(c), I-501.2, U-105, U-106 and U-107.
7) Ensure that flanged joints are bolted so that the gasket contact
faces bear uniformly on the gasket in accordance with 1989-ASME
B31.1, power piping, section 135.2.
