Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Heritage Manor did not provide the Hepatitis B vaccine, free of
charge, to employees having a high risk of being exposed to blood and
other body fluids.  Such employees would include nurses, certified
medicine aides, and certified nurses aides.
Among other methods,  one feasible and acceptable abatement methods
correct this hazard, as recommended by the Center for Disease Control's
Morbidity and Mortality Weekly Report dated June 24, 1988, volume 37,
no. 24, entitled "Update: Universal Precautions for Prevention of
Transmission of Human Immunodeficiency Virus, HepatitisB Virus, and
Other Bloodborne Pathogens in Health-Care Settings", is to offer the
Hepatitis B vaccine to those employees identified above.
