Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment or a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The International Model 2050 tractor being operated on uneven ground
as well as various ramps, moving material in and around the plant,
equipped with certified roll over protection was not provided with
approved seat belts that meet the requirements of Occupational Safety
and Health Administration Standard of 1926.602(a)(2) under Material
Handling Equipment.
Among other methods, one feasible and acceptable method to correct this
hazard is to contact the local International dealership and purchase the
appropriate seat belts for this piece of equipment and install them and
instruct the operator to utilize the seat belts when operating this
piece of equipment.
b) The case Model W-7 front end loader being operated on uneven ground
as well as various ramps in and around the plant was not equipped
with certified roll over protection as required by Occupational
Safety and Health Administration Standard 1926.602(a)(6) reference
Subpart "W" of 1926.1000(c)(1)(ii), nor did it have approved seat
belts as required by Occupational Safety and Health Administration
Standard of 1926.602(a)(2).
Among other methods, one feasible and acceptable method to correct this
hazard is to contact the local Case equipment dealer and purchase and
install the appropriate roll over protection as well as the appropriate
seat belts, and instruct the operator to utilize the seat belts when
operating this piece of equipment.
c) The International Model 2050 tractor being operated on uneven ground
as well as various ramps, moving material in and around the plant was
equipped with approved roll over protection that had been modified
with the welding of angle iron at various locations on the roll over
protective structure. No written documentation from the manufacturer
to show approval of the welding of additional material tothe roll
over protection did not change the safety capacities of the roll over
protection as required by Occupational Safety and Health
Administration Standard 1926.602(c)(1)(iii).
Among other methods, one feasible and acceptable abatement to correct
this hazard is to contact the manfacturer who built the roll over
protection and have and their engineer do appropriate testing to insure
that the original safety factor of the roll over structure has not been
reduced.
