Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that personnel were exposed to
the hazard of falling and being struck by a Case 580K tractorwith blade
and excavator attachments while being transported on the site by riding
on the side of this equipment.
Among other methods, one feasible and acceptable abatement method
to correct this hazard is by:
1) The immediate removal of personnel riding on equipment except for
training purposed, and then only when a seat is provided.
2) The reemphasis to personnel of the current Gabes Construction
Company, Inc. Safety Policy which prohibits the transportation of
passengers on construction equipment.
3) The initiation of disciplinary action against personnel violating
company safety rules.
